Terms of Service

These Terms of Service ("Terms") govern your access to and use of the swipeout mobile app, waitlist, and website at getswipeout.app (together, the "Services"), operated by swipeout from Australia. By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under the age of digital consent in your country, you may need a parent or guardian's permission to use them. By using the Services, you confirm you meet these requirements and that the information you provide (including your age) is accurate. Some features are age-restricted — for example, Nightlife content is hidden for accounts under 18.
2. Beta & waitlist
swipeout is in active development. Joining the waitlist does not guarantee access, a launch date, or any particular feature. The Services are provided on an evolving, pre-release basis and may change, pause, or be discontinued at any time.
3. Your account
You're responsible for activity under your account and for keeping your sign-in credentials secure. You may sign in via Apple or Google; their terms also apply to that sign-in. Tell us promptly if you suspect unauthorised use of your account.
4. Acceptable use & content standards
swipeout has zero tolerance for objectionable content and abusive users. You agree not to create, upload, share, or link to content — including custom cards, photos, names, descriptions, notes, and chat messages — that:
- is unlawful, or breaks the law or infringes another person's rights;
- is sexually explicit or pornographic, or that sexualises minors in any way;
- depicts or promotes graphic violence, gore, or cruelty;
- is hateful, harassing, bullying, or threatening, or promotes discrimination or violence against people based on protected characteristics;
- promotes self-harm, suicide, or eating disorders;
- promotes illegal goods, illicit drugs, weapons, or other illegal or dangerous activities;
- is spam, a scam, fraudulent, or deceptively impersonates another person or organisation;
- contains another person's private or personal information without their consent.
You also agree not to attempt to access, disrupt, scrape, reverse-engineer, or overload the Services or their infrastructure, or to misuse the waitlist (e.g. automated or fraudulent sign-ups).
To report objectionable content or a user, use the in-app report and block tools or email admin@getswipeout.app. We review reports and act on them — including removing content and removing or banning users — in a timely manner, typically within 24 hours. We may remove content and suspend or terminate accounts that violate these standards, at our discretion.
5. User content
You retain ownership of content you submit (such as custom cards, photos, notes, and group activity). You grant swipeout a non-exclusive, worldwide, royalty-free licence to host, store, display, and use that content as needed to operate and improve the Services, including showing it to members of groups you participate in.
6. Third-party content & data
Place, venue, and map information is provided by third parties (including Google Maps Platform). We don't guarantee its accuracy, availability, hours, pricing, or suitability. Always confirm details directly before relying on them.
7. Intellectual property
The Services, including the swipeout name, wordmark, design, and software, are owned by swipeout and protected by intellectual-property laws. These Terms don't grant you any rights to our branding except as needed to use the Services normally.
8. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We don't warrant that the Services will be uninterrupted, error-free, or secure. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law, swipeout will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Services. Where our liability cannot be excluded, it is limited (at our option) to re-supplying the Services or paying the cost of having them re-supplied.
10. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Services or other users.
11. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
